Oglala Sioux urges DC Circ. Ax SD uranium mine permit


Law360 (July 2, 2021, 5:03 p.m. EDT) – The Oglala Sioux tribe has urged the DC Circuit to reverse the US Nuclear Regulatory Commission approval of a uranium mine project in South Dakota, arguing that the agency violated several federal laws, one of which requires tribal consultation.

This appeal is the latest challenge launched by the Oglala Sioux tribe against a mine to be developed by Azarga Uranium Corp., linked to Powertech USA. The two sides fought for more than a decade to get its approval, and the current petition calls on the court to consider various NRC approvals that the tribe says have skipped certain steps required by the federal government.
